Terms
The deal, in plain words.
1. Who these terms are between
These terms are an agreement between you and 8lueberry Inc., a company incorporated in Québec and based in Montréal, which operates VIXI DIXI. “We”, “us” and “VIXI DIXI” mean 8lueberry Inc. “You” means the person who holds the account.
By creating an account or ordering a book, you accept these terms. If you do not accept them, please do not use the service. Our privacy policy forms part of this agreement and explains what we do with your personal information.
2. Who can use VIXI DIXI
You must be 18 or over to hold an account. An account belongs to one person. Keep your sign-in details to yourself, and write to hello@vixidixi.com if you think someone else has used them.
Many of our users record a parent or a grandparent. You may set up and run an account on someone else’s behalf as long as they know about it and agree, and you must stop if they ask you to. If the storyteller can no longer make that decision themselves, you need a protection mandate (mandat de protection) or equivalent authority, not simply a power of attorney.
3. What the service does
VIXI DIXI records or imports the stories you tell, transcribes them, groups them by theme, and drafts a book from them. You can read, edit and reorder everything before anything is printed. You can order the result as a digital book, an audiobook or a printed hardcover.
We may add, change or retire features over time. If we retire something you have paid for and not yet received, section 11 applies.
4. Your stories stay yours
You own the recordings you make, the transcripts we produce from them, and the book that comes out the other end. We claim no ownership of any of it, we do not publish it, and we do not sell it. We never use your stories to train AI models, ours or anyone else’s.
You can export your recordings, transcripts and books at any time, and you can delete them at any time. How deletion works is set out in section 10 of our privacy policy.
5. The permission you give us
To do the work, we need your permission to handle your content. You give us a licence to store, copy, transcribe, translate, edit, format and print your stories, and to send the parts that are needed to the service providers listed in our privacy policy.
That licence exists only so we can deliver what you asked for. It is not exclusive, we cannot use it for anything else, and it ends when you delete the content or close your account, except where we must keep a copy to meet a legal obligation.
6. Recording other people
Most life stories involve other people, and some are recorded as interviews. Before you record someone, you must have their agreement. The app asks the person speaking to agree at the start of an interview. Where they cannot use the app themselves, you confirm that you asked them and that they said yes.
For recordings you import of people who have died or cannot be asked, you confirm you have a reasonable basis to use them, for example as a member of their family. You are responsible for what you record and for the people you name in it. If someone asks us to remove their voice or information, we will tell you, and we will act directly where the law requires us to.
7. What the AI writes, and what we do not guarantee about it
Transcription, theme grouping and the first draft of every chapter are produced by automated tools, including third-party AI services. They are good, and they are not perfect. Names get misheard, dates get muddled, and a sentence can come out saying something you did not mean. Read your book before you print it: once you approve a print order, we produce exactly what you approved.
We make no promise about who holds copyright in text generated by a machine, because the law on that is unsettled in Canada and elsewhere. What we do promise is that we claim nothing in it, and that we will never assert rights against you over your own book.
8. What you may not do
Do not use VIXI DIXI to:
- record someone who has not agreed to it;
- store or print content that is unlawful, defamatory, hateful, or an invitation to violence;
- upload material you have no right to use, including someone else’s copyrighted work;
- break, probe or reverse-engineer the service, or try to reach another user’s data;
- resell the service, or use it to produce books for third parties as a business, unless we have agreed to that in writing.
If you do, we may suspend or close your account. Where we can, we will tell you first and give you a chance to export your archive.
9. Prices, taxes and payment
Prices are in Canadian dollars:
- Digital book: $65.
- Audiobook: $95. Not available yet, and we will not sell one until it is.
- Printed hardcover: $125, shipping included in Canada.
Applicable GST and QST are added at checkout. Payment is handled by our payment provider, and we never see or store your full card number. Prices can change, but never for an order you have already placed and paid for.
10. Printed books and delivery
Hardcovers are printed and shipped by our print partner. Production usually takes a few business days, and delivery time depends on where you are. The dates we show you are estimates, not guarantees.
Please give us a correct shipping address. We cannot redirect a book once it is in production, and a delivery that fails because the address was wrong is not refundable. Tell us within 30 days of delivery if a book arrives damaged or defective, and we will reprint it at our cost.
11. Refunds and cancellations
- Before your book is generated: cancel for any reason within 14 days of paying, and we refund you in full.
- After a digital book or audiobook is generated: the work is done and delivered, so the sale is final. If something went wrong in the making of it, write to us. We would much rather fix it than argue about it.
- Printed hardcovers: cancel any time before the book goes to print. Once it is in production we cannot stop it, but a book that arrives damaged or defective is reprinted at our cost under section 10.
- If we cannot deliver: if we retire a feature or fail to produce something you have paid for, you get your money back.
Refunds go back to the card you paid with. Nothing here takes away the rights the Québec Consumer Protection Act gives you.
12. Your account, and closing it
You can close your account at any time from the app. Export anything you want to keep first: closing an account starts the deletion described in our privacy policy, and we cannot undo it once it has run.
We may suspend an account that breaks section 8, that we are legally required to suspend, or whose payment has failed. We will give you notice and a chance to export your archive, unless the law stops us.
13. If a storyteller dies
A VIXI DIXI archive is meant to outlive the person who recorded it. You can name a legacy contact in your settings. On proof of death, that person gets access to your archive and can order books from it. Without a legacy contact, access goes to the liquidator of your estate, within the limits of the law. You can also ask that your archive be deleted at your death. The detail is in section 11 of our privacy policy.
14. Changes to the service and to these terms
We will tell you in advance, by email or in the app, before any change to these terms that affects you. The “Last updated” date at the top of this page always reflects the version in force, and we keep every past version.
If you keep using the service after a change takes effect, you accept it. If you would rather not, close your account, and we will refund anything you have paid for and not received.
15. What we do not promise
VIXI DIXI is provided as it is. We work hard to keep it running and accurate, but we do not promise that it will be available without interruption, that transcription will be word-perfect, or that a generated chapter will read the way you would have written it yourself.
VIXI DIXI is not a medical, psychological, legal or financial service. Recording a life story can be moving, and sometimes hard. It is not therapy, nothing in the product is advice, and we are not health professionals.
16. Limits on our liability
To the extent the law allows, our total liability to you for anything connected with VIXI DIXI is limited to what you paid us in the twelve months before the claim, and we are not liable for indirect or consequential loss.
Some liability cannot be limited by contract, and we do not try to. Nothing in these terms limits our liability for bodily or moral injury, for intentional or gross fault, or for anything else Québec law says cannot be excluded, and nothing limits the rights the Consumer Protection Act gives you.
17. Governing law, and where disputes are heard
These terms are governed by the laws in force in Québec and the federal laws of Canada that apply there. If we cannot settle something between us, the courts of the judicial district of Montréal have jurisdiction, except that a consumer may always bring an action in the district where they live, as the law provides.
Please write to hello@vixidixi.com first. Almost everything gets settled that way.
18. Language
These terms are published in French and in English, and both versions are equally valid.
